Data Protection and Legal Basis

The universities in the German federal state of North Rhine-Westphalia are legally obliged to evaluate their compliance with their duties, especially in the field of teaching. In order to ensure that they do so, section 7 subsections (2) and (4) of the Higher Education Act in North Rhine-Westphalia ("Hochschulzukunftsgesetz des Landes NRW") from 16th September 2014 stipulate that universities have the duty to ensure quality development and assurance by means of evaluation and that all members and affiliates of the university are obliged to help the university to fulfil this duty.

With regard to the use of personal data of former members and affiliates of the universities in North Rhine-Westphalia, section 8 subsection (5) of the Higher Education Act states that: "The universities are permitted to use the personal data of their former members and affiliates insofar as this is required for survey purposes within the framework of quality assurance and for evaluations in accordance with section 7 subsection 2 or to maintain contact with these individuals and the individuals concerned do not object to this use of their data. Survey participants must be informed that they provide their data voluntarily and are able to object to the use of these data. Further details are regulated by the University’s Evaluation Regulations."

The evaluation procedures at the University of Cologne are regulated by the Evaluation Regulations of the University of Cologne from 21st January 2015.
